Terms of Service

1.Who we are

FleetHub is an online fleet management platform provided by IT-SmartSystems, with registered office at Heestenweg 17, 2222 Heist-op-den-Berg, Belgium. Company number: 1041.263.326. Contact: info@fleethub.be.

2.Definitions

• Service: the FleetHub platform at app.fleethub.be and its features.
• Customer: the company that creates an account and uses the service.
• User: a person (administrator or employee) given access by the customer.
• Administrator: the user who manages the account and users on behalf of the customer.

3.Registration and account

A customer registers with an administrator account. The administrator is responsible for managing the users within the organization and for keeping login details confidential. The customer is responsible for all activity under its account.

4.The service and right of use

FleetHub grants the customer a non-exclusive, non-transferable right to use the service during the term of the agreement. The service may only be used for lawful purposes and in accordance with these terms.

5.Free version and trial

FleetHub is free for up to 5 users. A customer can request a trial of the Pro version; the request is reviewed and the trial has a fixed end date. After the trial the account remains, but the limits of the free version apply again until a subscription is taken out.

6.Pricing and payment

From 6 users onward a subscription of EUR 5 per user per month applies. Payment is handled through the payment provider. In case of non-payment, access to paid features may be suspended.

As long as FleetHub falls under the special exemption scheme for small businesses (art. 56bis Belgian VAT Code), no VAT is charged and the stated prices are the final prices. Should that scheme lapse, the price may change.

When additional licenses are purchased, the difference for the remainder of the current period is charged immediately on a pro rata basis. When licenses are reduced, the lower number takes effect from the next billing date; no mid-period refund is given. Access for a removed user ends immediately.

7.Term and cancellation

The agreement runs for as long as the account is active. The customer may cancel at any time; the subscription then ends at the close of the current billing period. Amounts already paid are not refunded, unless mandatory law provides otherwise.

8.Customer obligations

The customer does not use the service to bypass security measures, access data belonging to other companies, or process unlawful content. The customer ensures it has a valid legal basis to process the personal data it enters.

9.Availability and maintenance

We aim for high availability but do not guarantee uninterrupted service. Maintenance, updates or technical issues may temporarily affect the service.

10.Intellectual property

All rights to the platform, the software and the design remain with FleetHub. The customer remains the owner of the data it enters.

11.Personal data

The processing of personal data is governed by our privacy policy and the data processing agreement, which forms an integral part of these terms.

12.Liability

The service is provided "as is". To the extent permitted by law, FleetHub is not liable for indirect damages arising from the use of the service. Our total liability is limited to the amount the customer paid in the last twelve months.

13.Changes

We may update these terms from time to time. Material changes will be announced through the service or by email.

14.Governing law

This agreement is governed by Belgian law. Disputes are submitted to the competent courts of the judicial district of Antwerp.
